Processing of personal data

TGNCA s.r.o., Company ID: 09634231 with registered office Emilie Floriánová 810/2, 466 01 Jablonec nad Nisou, registered at the Regional Court in Ústí nad Labem under sp. zn. C 46079 (hereinafter referred to as “TGNCA”) indicates on what legal basis it processes personal data, for what purposes it uses it, to whom it can transfer it and what rights the customer has in relation to the processing of his personal data.

1) TGNCA processes the following personal data:

  • identification data, which means in particular the name and surname, company name, identification number, username, password and its hash;
  • contact details, in particular e-mail address, telephone number, delivery address and billing address;
  • account settings, which means data in the customer's account To process personal data, TGNCA authorizes the performance of the contract with the customer, compliance with legal obligations, legitimate interests of TGNCA or the consent of the customer.

2) When visiting the TGNCA website, cookies and other files necessary for the functioning of the TGNCA website are read to and from the customer's device. If the customer does not disable the use of cookies in his web browser, he is considered to agree to the use of cookies and the transfer of data to advertising and social networks. You can withdraw your consent at any time by disabling the use of cookies in your web browser settings.

3) TGNCA shall, on the basis of a legitimate interest, process personal data in order to:

  • improvement of the services provided
  • effective promotion of TGNCA products and services,
  • the provision of offers and advertising, sent by e-mail, text message,
  • testing new features and applications before deployment,

4) The customer has the right to object to processing on the basis of a legitimate interest.

5) Personal data are used for a period of 4 years (i.e. for the duration of the three-year limitation period and one year after its expiration with respect to claims made at the end of the limitation period) from the last login to the user account. In order to comply with legal obligations, TGNCA uses personal data for the period required by the relevant legislation, for a maximum of 10 years, unless in the future the legislation provides for a longer period.

6) TGNCA processes personal data provided to it by the customer in the context of using TGNCA services, creating and using the account.

7) All mentioned personal data is processed by TGNCA as controller.

8) TGNCA may also transfer personal data to other entities in the role of controller, namely:

  • based on the consent of the customer through advertising and social networks, namely:
  • Google Ireland Limited (registration number: 368047), with its registered office at Gordon House, Barrow Street, Dublin 4, Ireland; the privacy policy of this company is available here: https://policies.google.com/technologies/ads

9) The right of access includes, in particular, the right to know what data TGNCA processes about the customer, for what purpose, for what period, where it obtains the personal data, to whom it transmits it, who processes it outside TGNCA and what other rights the customer has related to the processing of his personal data.

10) The right to rectification includes the right for TGNCA to correct or supplement inaccurate personal data without undue delay.

11) The right to erasure includes the right to have the personal data of the customer erased without undue delay if:

  • the personal data is no longer required by TGNCA for the purposes for which it processed them,
  • the customer withdraws consent to the processing of personal data, which are data for the processing of which the customer's consent is necessary and at the same time TGNCA has no other reason why it needs to continue processing such data,
  • the customer objects to the personal data processed by TGNCA on the basis of legitimate interests and finds that he no longer has any such legitimate interests that would warrant such processing; or
  • the customer considers that the processing of personal data has ceased to comply with generally binding regulations.

This right does not apply if the processing of personal data continues to be necessary for the fulfilment of a legal obligation or for the determination, exercise or defence of TGNCA's legal claims.

12) The right to restriction of processing allows, in certain cases, to require that personal data be marked and that such data are not subject to any further processing operations for a limited period of time. The restriction occurs when:

  • the customer denies the accuracy of the personal data,
  • the customer will only prefer to limit the data before deleting the data
  • the customer objects to the processing

13) The right to portability gives the customer the right to obtain all personal data provided by TGNCA itself and processed by TGNCA on the basis of its consent and on the basis of the performance of the contract. Personal data will be provided in a structured, commonly used and machine-readable format.

14) The customer has the right to object to the processing of personal data that occurs on the basis of the legitimate interest of TGNCA. In the case of marketing activities, TGNCA will stop processing personal data without further ado; in other cases, it will do so unless it has serious legitimate grounds for continuing such processing.

15) The customer has the right to lodge a complaint with the competent supervisory authority. The customer may lodge a complaint against the processing of personal data with the Office for Personal Data Protection, with its registered office in Pplk. Sochora 27, 170 00 Prague 7.

16) The customer's request will be processed without undue delay, but within a maximum of one month. In exceptional cases, in particular because of the complexity of the request, the TGNCA is entitled to extend this period by a further two months. TGNCA will inform the customer about any extension.
